JUDGEMENT

(1.) Learned counsel for the respondents has raised an objection that since the petitioner has given up Respondent Nos. 2 and 3 i.e. the firm and other partner Subash Chander as party to the revision petition, the revision petition is not maintainable.
(2.) Learned counsel for the petitioner states that he does not claim any relief against Respondent Nos. 2 and 3 and the decree-holder is at liberty to execute the decree against them if it has become final. He submits that the decree has not become final against them because it is an indivisible decree and it has to survive or set aside as a whole.
(3.) The submission of learned counsel for the petitioner is accepted. The decree is indivisible. The judgment-debtors viz. the firm and one of its partners have accepted the decree. Once the decree is accepted against the firm, the partners individually and the firm is liable for the acts of the firm. The revision petition in the absence of necessary parties is not maintainable and is liable to be dismissed on this sole ground.;
