JUDGEMENT

(1.) Heard counsel for the parties.
(2.) The challenge in this writ petition relates to the non-release of the pensionary benefits to the petitioner. It is no more in dispute that the petitioner opted for voluntary retirement from service with effect from July 31, 1993, and he was accordingly relied from July 31, 1993 after office hours. However, the Government accepted the request of the petitioner for voluntary retirement vide its order dated August 11,1994, with effect from July 31,1993.

The petitioner has been making various representations between August, 1993 and August, 1994, to the concerned authority to release his pensionary benefits it appears that the Government has not even fixed any interim pension, with the result, the petitioner was deprived of his pensionary benefits from August, 1993. Even today, the pensionary benefits are not finalised. More than a year has passed and in our opinion, the explanation given by the State Government for delayed pensionary benefits to the petitioner cannot be accepted. We accordingly direct to the respondents to finalise the petitioner's pensionary benefits as expeditiously as possible and preferably before January 31, 1995, if the pensionary benefits are determined on or before January 31, 1995. The respondents shall pay 12 per cent interest there on. In the event, the respondents fail to determine the pensionary benefits of the petitioner by January 31, 1995, they shall pay 18 per cent Interest on the accrued amount of pensionary benefits, Writ petition to stand accordingly disposed of. Since the State has made the statement that they will finalise the petitioner's case for pensionary benefits by January 31 1995. We do not propose to award any costs. Ordered accordingly.;
