JUDGEMENT

- (1.) The petitioner is working as Assistant Professor in Regional Engineering College, Kurukshetra. He claims promotion under Scheme Annexure P/3 in the pay-scale of Rs. 4500-5700. This scale was not being given to the petitioner that he has approached this Court under Article 226 of the Constitution.
(2.) On notice of motion having been issued, written statement has been filed by the official respondent (No. 2)-Principal, Regional Engineering College, Kurukshetra, contesting the petition, stating that the petitioner is not fulfilling the academic qualifications for the post of Professor under the Scheme Annexure P/3. Rejoinder was also been filed by the petitioner to the written statement.
(3.) After hearing counsel for the parties, we are of the view that no case for interference is made out. If Scheme Annexure P/3 is to be taken, under which the petitioner has given notion vide Annexure P/4, it is to be read as a whole. In para 1 of the Scheme, it is provided that for giving option for the post of Professor in the pay scale of Rs. 4500-5700, the requisite eligibility conditions are to be fulfilled prescribed in para 2, thereof, which reads as under:- "2. Qualifications and experience prescribed for promotion under above scheme are given below:- (a) Qualifications (i) Professor Ph.D. with 1st Class degree at Bachelor's or Master's level in Engineering/Technology. Or Ph.D. Degree with 1st Class M.Sc. in appropriate branch for teaching posts in Humanities and Sciences. (ii) Assistant Professor First Class Master's Degree in Appropriate Branch of Engineering/Technology. Ph.D. in appropriate branch with 1st Class in Master's Degree in case of teaching posts in Humanities and Sciences. (b) Experience Completed 8 years of continuous service as Assistant Professor or Lecturer, as the case may be, of which at least 4 years should be in this college.";
