JUDGEMENT
M.R.Sharma, J. -
(1.) The petitioner has been convicted under section 16(l)(a)(i) of the Prevention of Food Adulteration Act. It is alleged that he was selling sub-standard cows milk. The result of the chemical analysis shows that the sample obtained from him contained milk fat 5.6% as against the standard 4% and milk solids 6% as against the standard 8.5%. In other words, milk fat and solids totalled 11.6% as against 12.5%. The deficiency was of .9%. This deficiency is not that small which can be ignored. However, it is a relevant circumstance for being taken into consideration for awarding the sentence. The petitioner is a first offender and at the time of the admission of this petition, he was ordered to be released on bail. Under these circumstances the sentence of imprisonment awarded to him is reduced to that already undergone by him. He shall, however, have to pay the fine of Rs. 1000.00imposed on him subject to the condition of imprisonment in defualt. The petitioner is allowed only to the extent indicated above. Petition partly allowed.;
