JUDGEMENT

(1.) THE present petitioner along with one Manjit Singh son of Balbir Singh was arrayed as an accused in FIR No.185 dated 24.12.2011, under Sections 324,34 of the Indian Penal Code, registered at Police Station Garhshankar, District Hoshiarpur on the allegations that he had caused injuries to the complainant.

BRIEF facts are that the complainant, namely, Simarjit Singh son of Lehmbar Singh got his statement recorded before the police that he is working as Handling Labourer in FCI, Garhshakar and on 16.12.2011, at about 3.00 p.m., he was coming out from the godown of FCI situated near the grain market and at that point, Amarjot Singh @ Navjot Singh @ Jota (present petitioner) armed with kirpan and Manjit Singh, co -accused empty handed along with 2 -3 other unidentified persons came on motor cycles. Manjit Singh is stated to have raised a lalkara to catch hold of the complainant so as to teach him a lesson. Further allegation was that the present petitioner gave a kirpan blow on the left arm of the complainant due to which he fell down and thereupon the unidentified persons gave danda blows on the back side of his neck. Thereafter the accused fled away from the spot. The motive attributed was of some criminal litigation between the complainant and accused persons and on account thereof a grudge having been nursed.

IN the ensuing trial, the trial Court held the present petitioner guilty and he was convicted for offence under Section 323 read with Section 34 of the Indian Penal Code and sentenced to undergo rigorous imprisonment for one year and a fine of Rs. 1,000/ - was imposed and in default thereof, to further undergo imprisonment for seven days. The petitioner was also convicted for offence under Section 324 read with Section 34 of the Indian Penal Code and sentenced to undergo rigorous imprisonment for one year and imposed a fine of Rs. 1,000/ - and in default thereof, to undergo imprisonment for seven days. Both the sentences were directed to run concurrently.
The trial Court also convicted co -accused Manjit Singh.;
