- (1.) PRAYER in this petition, filed under Section 482, Cr.P.C., is for quashing of cross version registered vide DDR No. 22 dated 12.10.2008 (Annexure P2) in a case arising out of FIR No. 77, dated 12.10.2008, for the offences punishable under Sections 148, 323, 324 and 326 read with Section 149, IPC, registered at Police Station, Kathgarh, District Shaheed Bhagat Singh Nagar, and the consequential proceedings arising therefrom, on the basis of compromise dated 26.04.2013 (Annexure P3).
(2.) VIDE order dated 18.09.2013, the affected parties were directed to appear before the learned trial Court for getting their respective statements recorded with regard to the compromise. The said Court was also directed to report to this Court with regard to the genuineness of the statements to be suffered by the respective parties and the validity or otherwise of the compromise allegedly effected between the parties.
(3.) IN compliance of the above, the petitioners Pardeep Kumar, Ravi Kumar, Surinder Kumar, Sunita, Ajay Kumar, Maya and Mona as well as the complainant -respondent, Raj Kumar, did appear before the Court below and got recorded their respective statements with regard to the compromise. The complainant -respondent Raj Kumar suffered the following statement: - "That in the above noted case with assistance of respectable persons, a compromise has been effected with the accused. A compromise has effected as per our own choice. There is no pressure or any undue influence over anybody to effect the compromise. We the parties of the present case are residing in the same locality and are neighbours. I have no grudge against the accused. As per compromise we have filed a quashing proceedings in the Hon'ble Punjab and Haryana High Court, Chandigarh, which is pending for 13.11.2013.";
