JUDGEMENT

- (1.) As, identical questions of law & facts are involved, therefore, I propose to decide the above indicated petitions bearing CRM No.M-39148 of 2014, titled as Mudit Mohindra and others Versus State of Punjab and another(for brevity "the 1st case") and CRM No.M-39150 of 2014, titled as Adarsh Kumar Bhambri and others Versus State of Punjab and another(for short "the 2nd case"), arising out of the property in dispute between the parties, who are closely related with each other, by means of this common judgment, to avoid the repetition of facts.
(2.) The contour of the facts & material, which needs a necessary mention for deciding the core controversy, involved in the instant petitions and emanating from the record is that, initially in the wake of complaint of complainant-Sachin Bhambri son of Adarsh Kumar Bhambri(respondent No.2)(for brevity "the complainant"), a criminal case was registered against the petitioners-accused-Mudit Mohindra son of Rakesh Mohindra and others, vide FIR No.93 dated 14.06.2014 (Annexure P-1), on accusation of having committed the offences punishable under Sections 380, 427, 511, 506, 447, 148, 149 and 323 IPC, by the police of Police Station Doraha, District Ludhiana(subject matter of 1st case).

Sequelly, in pursuance of another complaint of complainantSahil Bhambri son of Sanjeev Bambri, respondent No.2(for short "the complainant in the 2nd case"), another criminal case was also registered against the petitioners-accused-Adarsh Kumar Bhambri son of Satdev Bhambri and others, vide FIR No.138 dated 16.08.2014(Annexure P-1), for the commission of offences punishable under Sections 435, 506 and 34 IPC, by the police of same Police Station Doraha, District Ludhiana (subject matter of 2nd case).;
