JUDGEMENT

- (1.) THIS order shall dispose of the present petition preferred under Section 438 Cr.P.C. seeking the concession of pre -arrest bail to the petitioner in FIR No. 190 dated 09.11.2013, under Sections 406/498 -A IPC, registered at Police Station Bhawanigarh, District Sangrur. Counsel for the parties have been heard at length.
(2.) THE present petitioner is the mother -in -law of the complainant, namely, Harpreet Kaur.
(3.) ON 03.01.2014 while issuing notice of motion and while granting interim protection to the petitioner, the following order was passed by this Court : - "Learned counsel for the petitioner states that marriage of petitioner's son was solemnized with the complainant way back on 06.02.2005 and before registration of the present FIR, a civil suit was filed by the complainant. However, the matter was amicably resolved vide agreement dated 12.10.2013. The present FIR has been registered on 09.11.2013. Since the marriage was solemnized in the year 2005, an effort can be made to relegate the matter to the Mediation and Conciliation Centre of this Court. As such, on an oral request of learned counsel for the petitioner, the complainant is impleaded as party to the present petition. The petitioner is directed to deposit Rs.10,000/ - with the Registry of this Court as litigation expenses. Notice of motion for 28.01.2014. Meanwhile, the petitioner is directed to join the investigation as and when called by the Investigating Officer. In the event of her arrest, she shall be released on bail by the Investigating Officer on her furnishing bail bonds/sureties to his satisfaction, subject to the following conditions, as envisaged under Section 438(2) Cr.P.C.: - (i) that the petitioner shall make herself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer; (iii) that the petitioner shall not leave India without the previous permission of the Court; (iv) such other condition as may be imposed under sub section (3) of Section 437, as if the bail were granted under that section." Thereafter it so transpires that since respected counsel for the parties had shown their inclination towards a possible reconciliation between the parties and to arrive at a compromise, the parties had been directed to appear before the Mediation and Conciliation Centre of this Court.;
