JUDGEMENT

(1.) Reply filed in court on behalf of respondent No.3 is taken on record.
(2.) The petitioner, who was admitted to Post Graduate Medical course for the Session 2013 came by certain conditions that were set out in the prospectus as regards a candidate who obtained admission in 40% State quota. The requirement was having to enter into a bond setting out the stipulations that included (i) that a candidate shall serve for 3 years within the State of Punjab, provided, however, if the State was unable to give employment status, he would be relieved of the obligation; (ii) that the candidate should inform the government that he has passed the postgraduate examination; (iii) that in the event of candidate not subjecting himself to the bond, the candidate will not be given the stipend; (iv) the breach of bond would entail a recovery of Rs. 15 lakhs from the candidate. The petitioner chose not to give the bond and denied himself the benefit of stipend.
(3.) In the succeeding year in 2014, there is a compulsion for giving a bond for every student that gained admission. There was no exception made to any candidate in the manner it was done for the year 2013. The prospectus of the year 2014 was sought to be applied to the petitioner and was called upon to enter into a bond. The petitioner was demurred and before this court.;
