JUDGEMENT

(1.) PETITIONER Sanjeev Kumar son of late Mani Ram has preferred the instant petition for the grant of concession of anticipatory bail, invoking the provisions of section 438 Cr.PC, in a case registered against him along with his mother and other co -accused Kanta Devi, vide FIR No.205 dated 27.4.2013 (Annexure P2), for the commission of offences punishable u/ss 406, 498 -A and 120 -B IPC by the police of Police Station Sector 5 Panchkula.
(2.) NOTICE of the petition was issued to the State.
(3.) AFTER hearing the learned counsel for the parties, going through the record with their valuable help and after deep consideration over the entire matter, to my mind, the present petition deserves to be accepted in this respect.
During the course of preliminary hearing, a Coordinate Bench of this Court (Ram Chand Gupta, J.) passed the following order on 17.7.2013: -
"Contends that marriage is 12 years old and that two daughters were also born out of the wedlock. Further submitted that petitioner is a Government employee and he is ready to rehabilitate the complainant in the matrimonial home. It is further contended that differences between the petitioner and the complainant are not such that cannot be resolved.
On oral request of learned counsel for the petitioner, complainant is permitted to be impleaded as respondent no.2 on filing of her complete address. Notice of motion for 16.8.2013.
However, petitioner is directed to bring Rs. 25,000/ - on the next date of hearing for being paid to respondent no.2 as her expenses for attending this Court.
However, in the meantime, petitioner is directed to join the investigation and in case he is arrested, he shall be released on interim bail by the Arresting Officer to his satisfaction subject to compliance of conditions specified under Section 438(2) Cr.P.C.";
