The petitioners are seeking a writ in the nature of certiorari for quashing the impugned letters dated 03.12.2010, 08.12.2010 (Anexures P-9 and P-10), whereby respondent-University has allowed respondent Nos. 7 to 10 to take over the Managing Committee of Bhagwan Parshu Ram College Education Society without holding any elections. The petitioners are further seeking a writ of Quo Warranto against respondent Nos. 7 to 10, who are holding the Managing Committee without there being any elections as per the information received under the Right to Information Act, 2005 vide Annexures P-11 and P-12. They are also seeking a direction to the elections in consonance with the provisions of Kurukshetra University Calendar.

The petitioners are life Members of Bhagwan Parshu Ram College Education Society, Kurukshetra, which is governed under the memorandum of association as well as the amended Rules and Regulations (Annexure P-1), which provide for existence of a General Body of the Society consisting of all the life members and Managing Committee consisting of 11 Members elected out of the life Members.
(3.) On 18.04.2008, elections were conducted by the Administrator and the result was declared. Sh. Subhash Gaur was declared to be elected as President of the Managing Committee vide Annexure P-7. After election of the President, the Administrator relieved her charge on 21.04.2008 (Annexure P-8). The said elections were held on the directions given by this Court and the Managing Committee was constituted on 18.04.2008 for three years and its tenure was to expire on 17.04.2011. Before the expiry of tenure of the Managing Committee, Kurukshetra University-respondent No.1 issued a letter dated 03.12.2010 (Annexure P-9) to the Principal of the College informing that the earlier Governing Body had been terminated and the new Governing Body had been constituted. A letter dated 08.12.2010 (Annexure P-10) was also written to the Manager of United Bak of India, Sector 7, Kurukshetra, informing that the new Managing Committee had been constituted and they will operate Account No.1461050000438 in the name of Bhagwa Parshu Ram College Education Society. This action of the respondents is under challenge in this petition.;
