JUDGEMENT

- (1.) CRM No.4297 of 2014 By way of this application, it is prayed that in the heading and prayer clause of the main petition, offences under Sections 494, 420 and 120 -B of the Indian Penal Code, 1860 (for short, 'IPC'), be also included. Learned counsel for the respondents have no objection if the application is allowed.
(2.) IN the circumstances, the application is disposed of with a direction that reference to offences wherever occurring in the petition shall mean to include offences under Sections 494, 420 and 120 -B, IPC. CRM -M -2369 of 2014

BY way of this petition under Section 482 of the Code of Criminal Procedure, 1973 (for brevity, 'the Code'), petitioners, the accused in FIR No.57 dated 20.08.2013 (Annexure P -1) recorded at Police Station, Hariana, District Hoshiarpur, under Sections 498 -A and 406, IPC, with Sections 494, 420 and 120 -B, IPC, added lateron, seek quashing of the aforesaid FIR and proceedings emanating therefrom by stating that the matter has been amicably settled between them and complainant/respondent No.2 vide deed of compromise dated 17.12.2013 (Annexure P -2). It comes out from the record that the FIR (Annexure P -1) was recorded on the statement of respondent No.2 on the allegations that the petitioners were demanding dowry from her and were ill -treating her for and in connection with demand of dowry. In the compromise (Annexure P -2), it is specifically stated that the petitioners have agreed to return jewellery to the complainant/respondent No.2 besides payment of an amount of Rs.8 lacs towards permanent alimony. Out of agreed amount of Rs.8 lacs, an amount of Rs.3 lacs was received by the complainant/respondent No.2 through Demand Draft No.305493 dated 17.12.2013 drawn on Syndicate Bank, Adampur Branch, Jalandhar, and the remaining amount is agreed to be paid to her on the last date fixed for disposal of the divorce petition. This position has been confirmed in the petition as also in the report dated 21.02.2014 received from the learned trial Court.;
