JUDGEMENT

- (1.) PRAYER in this petition is for quashing of FIR No. 163, dated 14.8.2012, under Sections 406 and 420, IPC, registered at Police Station, Phillaur, District Jalandhar, and all the consequential proceedings arising therefrom, on the basis of the compromise.
(2.) VIDE order dated 11.12.2013, the affected parties were directed by this Court to appear before the learned Area Magistrate for getting their respective statements recorded with regard to the compromise and a direction was also issued to the learned Area Magistrate to send his/her report qua the genuineness of the compromise along with copies of the statements.
(3.) IN compliance of the above, both the petitioners, namely, Amit Pamma and Vishal Pamma as well as respondent No. 2/complainant, Naval Kishore Sharma, did appear before learned Sub -Divisional Judicial Magistrate, Phillaur, and got recorded their respective statements with regard to the compromise. Respondent No. 2/complainant, Naval Kishore Sharma stated as under: " I have compromised the matter with the accused persons named Amit Pamma and Vishal Pamma, sons of late Brij Bhushan Pamma, residents of Grain Market, Phillaur, District Jalandhar. Now I have no grudge against the accused persons. I have effected compromise without any coercion, pressure, threat or fear. I have no objection if impugned FIR registered against the above stated accused persons be quashed and they be acquitted. Photocopy of compromise is mark A." Similar statements were suffered by the petitioners. The compromise deed (Mark 'A') was also produced before the learned Sub -Divisional Judicial Magistrate, Phillaur. The report received from the learned Court below reveals that the parties have effected the compromise with their free will, without any coercion or pressure and, therefore, the same is genuine one.;
