JUDGEMENT
T.P.S.MANN, J. -
(1.) PRAYER made in the petition is for quashing of FIR No.447 dated 9.11.2012
under Sections 323/406/498 -A/506 IPC registered at Police Station Mahesh
Nagar, Ambala Cantt. and for setting aside all the proceedings arising
therefrom.
(2.) THE aforementioned FIR was registered on the basis of an application submitted by respondent No.2 -Gurpreet Kaur before the Deputy Commissioner
of Police, Ambala wherein the petitioners were arraigned as accused.
Quashing of the FIR is sought on the ground of compromise as according to
the petitioners, the relatives and well wishers of both the parties
intervened and amicably settled the matter. Pursuant to the same,
respondent -Gurpreet Kaur started living with petitioner -Gurdeep Singh in
the matrimonial home besides withdrawing the petition filed by her under
Section 125 Cr.P.C.
Upon notice, respondent -Gurpreet Kaur has appeared and got recorded her statement separately which reads as under: -
''Stated that I was married to Gurdeep Singh petitioner on 28.11.2010. Later on, there arose certain misgivings in the minds of the parties and, accordingly, I had lodged FIR No.447 dated 9.11.2012 under Sections 323/406/498 -A/506 IPC against my husband Gurdeep Singh, father -in -law Balwant Singh and mother -in -law Jaswinder Kaur. I had also filed a petition for maintenance. Now, no dispute remains between me and my husband and his parents. Accordingly, I have started living with my husband -Gurdeep Singh in the matrimonial home. I have also withdrawn the petition for maintenance filed by me against my husband. I may mention here that earlier there were some differences between me and my parents. After meeting my parents in the retiring room of this Court for some time, I have no objection if my parents meet me off and on. However, they should give me some time before I settle down in my matrimonial home, once again. However, it would be open to my parents to call me on phone or mobile to know my welfare. In view of the fact that the matter stands compromised with the petitioners and I have, once again, started living alongwith my daughter at my matrimonial home, I have no objection if the FIR registered at my instance is quashed and all the proceedings taken thereunder set -aside. ''
(3.) RESPONDENTS No.3 and 4, who are parents of respondent -Gurpreet Kaur, have also got recorded their joint statement, which is re -produced
here -in -below: -
''Stated that at the intervention of the Court, both of us had a chance to meet our daughter Gurpreet Kaur in the retiring room for some time. We also took our grand -daughter in our lap and showered our blessings upon her. We have no objection of our daughter Gurpreet Kaur going back to her matrimonial home and starting her life afresh. We also undertake not to unnecessarily interfere in the matrimonial life of our daughter. Our daughter has got recorded in her statement that she would have no objection to our visit to her house but she needs some time before we go to her house. We assure this Court that for a period of at least three months from today we will not do so. However, we be permitted to talk to our daughter on phone/mobile atleast once a week. ''
Learned counsel for the petitioners has informed the Court that after
completion of the investigation, the police has presented the challan.;
