JUDGEMENT

- (1.) THE petitioner is seeking issuance of direction to respondent No. 3 to investigate the matter of death of his wife and a direction to respondent No.1 for granting the compensation of Rs.10 lac on account of death of his wife.
(2.) THE brief facts of the case are that Gurmeet Kaur, aged about 55 years, wife of the petitioner died due to electrocution on 19.11.2011. She was accompanied her son on his motorcycle and she going from Billona to Nadana on Badnara Nissing Road. There was a transformer of Electricity Department and two employees were working on the said transformer. Due to their negligence and carelessness, an electric cable (wire) of the said transformer fell on the motorcycle and the said wire struck against the neck of petitioner No.2 Gurpej Singh and his mother Gurmeet Kaur, who was sitting on the pillion seat of the motorcycle. The petitioner No.2 as well as his mother fell down and Gurmeet Kaur succumbed to the injuries on the spot.

AS per the certified copy of post -mortem report (Annexure P -3) and copy of death certificate (Annexure P -4), the cause of death as under: - ' the cause of death in this case is due to cardio respirator failure due to injury to trachea and spinal chord as described in post - mortem report which is sufficient to cause death in normal cause of life and 4 injuries described in report are ante -mortem in nature.' ? Thereafter an FIR No.287/11 (Annexure P -2) under Section 304 -A, IPC and 139 of the Electricity Act was registered against the employees of respondent No.1 namely Rajesh Kumar and Jai Dev sons of Jai Narayan resident of village Badnara, District Kaithal. The petitioner made a representation (Annexure P -5) for conducting fair investigation against the employees of the Board.;
