JUDGEMENT

SURYA KANT,J. - (1.) The challenge in this writ petition is to the orders dated 26.03.2012, 22.08.2012 and 25.03.2014 (Annexures P-1, P-2 & P-3, respectively), whereby the petitioner has been evicted from a part of the public street encroached upon by him.
(2.) The factual aspect of the case would reveal that the petitioner has raised construction on an area measuring 2 karam x 4 karam taken out of the public street. Owing to the ordinary width of the public street in the rural areas, it appears to us that the petitioner has encroached upon a substantial part of the public street. In these circumstances, no fault can be found with the eviction order which is accordingly upheld.
(3.) Faced with this, learned counsel for the petitioner submits that he is willing to purchase the encroached land at the current price in accordance with the provisions of Rule 12 (4) of the Punjab Village Common Lands (Regulation) Rules, 1964, as applicable to the State of Haryana.;
