JUDGEMENT
Augustine George Masih, J. -
(1.) PETITIONER has approached this Court praying for the grant of the benefit of Haryana Government Notifications dated 14.05.1991 as well as 26.06.1992 on the analogy of grant of this benefit to the Private Secretaries working in the Haryana Civil Secretariat in the same pay -scale. Claim is primarily based on grant of additional increment.
(2.) COUNSEL for the respondents has brought to the notice of the Court the order passed by this Court in C.W.P. No. 16349 of 1992 where similar claim made by another employee has been considered by the Division Bench of this Court and rejected the same. I have considered the judgment passed by the Division Bench and I am of the view that the claim of the petitioner is covered against him by the ratio of the said judgment. The Division Bench judgment reads as follows: - -
The claim of the petitioner for open ended scale cannot, indeed, be sustained. This benefit has been restricted to Group C & D employees only and for valid reasons, namely, their low salaries and little or no chances of promotion during their service career.
The main stress of the counsel for the petitioner was upon this open ended scale also having been extended to the librarians whose scale of pay is the same as that of the petitioner and to private secretaries, even though they are in Group B.
As regards the private Secretaries, it has been explained that this benefit has been given to them on account of the arduous nature of their duties. It was pointed out in this behalf that they are required to attend to the Ministers/Officers not only before and after office hours on working days but also on holidays. In the case of librarians, it would appear that it was on account of their limited scope of promotion that this benefit has been extended to them.
No occasion, thus, arises for granting to the petitioner the relief claimed. Dismissed.
(3.) FINDING no merit in the present writ petition, the same stands dismissed.;
