JUDGEMENT

(1.) This revision petition has been filed challenging the judgment dated 20.08.2008 passed by learned Additional Chief Judicial Magistrate, Gurdaspur as well as the judgment dated 19.02.2014 passed by learned Additional Sessions Judge, Gurdaspur whereby the appeal filed by the petitioners has been dismissed. The petitioners Lakhwinder Singh @ Bittu, Surjit Singh @ Bittu and Raghbir Singh @Beera were convicted under Sections 326/324/323/34 IPC and sentenced to undergo imprisonment by the learned trial court as under:-

(2.) The brief facts of the case are that, the petitioners are alleged to have caused injuries on the person of complainant Surta Singh. Petitioner No.1 Lakhwinder Singh @ Bittu alleged to be armed with a sword has been attributed an injury on the finger of the right hand of Surta Singh as well as on thumb and middle portion of the right hand, which resulted in chopping/amputation of the thumb and a little portion of the middle finger of the right hand of Surta Singh. Petitioner No.3 Raghbir Singh @ Beera alleged to be armed with a sword, is stated to have chopped of the thumb and a part of the index finger of the left hand of Surta Singh as well as caused an injury on the back of the right hand of Surta Singh. Petitioner No.2 Surjit Singh @ Bittu alleged to be armed with an iron rod is alleged to have caused an injury on the head and backside of the complainant Surta Singh. Another co-accused Diwan Singh, who has since been acquitted by the learned Additional Sessions Judge, Gurdaspur vide the impugned judgment itself, was alleged to have raised a Lalkara.
(3.) Learned trial court after appreciating the evidence on record found the petitioners as well as Diwan Singh to be guilty of the offences as alleged against them. They were convicted for the commission of said offences as detailed above. On an appeal preferred by the present petitioners as well as Diwan Singh, the learned Additional Sessions Judge, Gurdaspur while acquitting Diwan Singh of the charges against him, has upheld the conviction and sentence qua the present petitioners.;
