JUDGEMENT

(1.) Surinder Pal Singh-petitioner has filed this petition under Section 482 Cr.P.C. praying for quashing of FIR No.53 dated 9.2.2013 (Annexure-P.1) registered for the offence under Section 307 IPC at Police Station Civil Lines, District Batala and all subsequent proceedings arising therefrom in view of the compromise dated 13.3.2014 (Annexure-P.2). The FIR has been registered on the statement of complainant- Bikramjit Singh on the allegations that a person having Mulla type beard had fired on him from his revolver, but he saved himself by hiding at the back side of the stage. There was a marriage function going on at the time of alleged incident and loud music was being played at the function, where the guests from both the sides were dancing on D.J. and from that crowd no body knows that who had fired in the air and respondent No.2 misunderstood that the said fire was fired upon him with an intention to kill, whereas there was no such intention or occasion with the petitioner to fire upon the complainant as alleged in the FIR.
(2.) Learned counsel for the petitioner contends that the petitioner has not been named in the FIR. A perusal of the FIR would show that a young man of 30 years having Mulla type beard and 7/8 other unidentified persons have been referred to in the FIR as none has been named in the FIR. It is during the investigation of the case the name of the petitioner came to light and no identification or any name of any other person came to light. He further contends that perusal of the FIR would show that it is a case of no injury. Now with intervention of respectable persons and relatives, the matter has been amicably compromised between the parties to enhance peace and harmony.

Keeping in view the fact that the parties have entered into a compromise, they were directed to appear before learned Chief Judicial Magistrate, Batala for getting their statements recorded in support of the compromise. After doing the needful, learned Judicial Magistrate Ist Class, Batala has sent his report dated 28.5.2014 submitting that the compromise arrived at between the parties is without any pressure or coercion from any one and the same is genuine one. Complainant Bikramjit Singh has stated that compromise has been entered into and he does not want to proceed against them. Now he has no grudge against the accused persons. He has suffered this statement without any coercion or pressure and with his free will and he has no objection if the present FIR is quashed.;
