The petitioner has filed the present writ petition seeking a writ of certiorari to quash order dated 30.4.2008 passed by the Estate Officer, Punjab State Agricultural Marketing Board, Chandigarh (in short "PSAMB"), dismissing the claim of the petitioner for allotment of shop in New Grain Market, Bhikhi, District Mansa and also orders dated 30.3.2010 and 4.6.2010 passed in appeal and in revision upholding the order passed by the Estate Officer.

The petitioner firm is a licensed dealer as 'Commission Agent' under Section 10 of the Punjab Agricultural Produce Markets Act, 1961 (in short 'the Act') and has been running its business in Anaj Mandi, Bhikhi, District Mansa. In order to remove congestion, the Market committee decided to shift the Anaj Mandi to its new site at Bhikhi. To facilitate shifting, 31 acres of land was acquired for setting up a notified market yard. Applications were invited through publication from eligible licensed dealers for allotment of plot on reserve price at the new market yard. The petitioner firm submitted the application accompanied with necessary documents to support its claim. The Estate Officer rejected the claim of the petitioner firm with the following observation: "As reported by the Allotment Committee your firm is working and applied from the premises located outside Old Grain Market, Bhikhi as duly specified in the Notification No. 9026/AGRI/5983 dated 29.10.1963. Thus, you do not fulfill the condition of having premises in the Old Grain Market as contained in Punjab State Agricultural Marketing Board Sale and Transfer of Plots Rules, 1999 as amended in 2008 sub-rule 3 (v) for allotment of plot in the New Grain Market, Bhikhi."
(3.) The petitioner firm challenged the order passed by the Estate Officer in an appeal, which was dismissed on 30.3.2010. Similarly, the Revision Petition was also dismissed on 4.6.2010. Aggrieved against such orders, the present writ petition has been filed.;
