JUDGEMENT

- (1.) Prayer made in the petition is for quashing of FIR No.106 dated 27.3.2008 under Sections 324, 148 and 149 IPC, to which offence under Section 326 IPC was added later on, registered at Police Station City, Kapurthala. The aforementioned FIR was registered on the basis of statement made by respondent No.2-Narinder Sharma wherein he stated that on 6.3.2008 at about 8.00 p.m., he had gone to meet his friend Narinder Singh @ Mansurespondent No.3. Said Narinder Singh @ Mansu received a call from his friend Harjinder Singh @ Raja that a fight had taken place between him and 5/6 boys and both the parties had sustained injuries and were going to Civil Hospital, Kapurthala. Upon this, Narinder Sharma and Narinder Singh @ Mansu left for Civil Hospital, Kapurthala. When they reached near Jain Petrol Pump, 6/7 persons were standing there. Out of them Pardeep Singh @ Lavi and Balwinder Singh @ Bainja, armed with datars, and Jatinder Singh @ Pardhan were known to him. Soon thereafter, an altercation ensued in which Pardeep Singh @ Lavi, Balwinder Singh @ Bainja and Jatinder Singh @ Pardhan, alongwith unidentified persons, caused injuries to Narinder Singh @ Mansu.
(2.) Accordingly, the aforementioned FIR was registered for offences under Sections 324/148 and 149 IPC. Subsequently, offence under Section 326 IPC was added to the heading of the FIR.
(3.) The quashing of the FIR is sought on the ground that subsequent to the registration of the FIR and the presentation of the challan, the matter between the petitioners on the one side and respondents No.2 and 3 on the other stood amicably settled. In this regard, respondents No.2 and 3 had sworn in their respective affidavits, copies of which stand appended with the petition as Annexures P-2 and P-3, respectively.;
