JUDGEMENT

- (1.) This revision has been filed against the concurrent findings of conviction recorded against the petitioner by both the Courts below for offences under Sections 325/323 of the Indian Penal Code (IPC). The trial Court sentenced the petitioner as under:- JUDGEMENT_956_LAWS(P&H)7_2014_1.html
(2.) The incident took place on 21.8.2006 at about 4.00 p.m. Raghbir Singh-complainant had taken his buffaloes to the canal for bath. The petitioner was also standing on the bank of canal and washing his bicycle. The buffaloes of the complainant rushed out of the canal as a result of which some canal water spilled over the bicycle of petitioner. Petitioner who felt annoyed started abusing the complainant. The petitioner then picked up a stone and threw it towards the complainant hitting him on the mouth and three front teeth of the upper jaw were broken. Avtar Singh brother of the complainant was also present and witnessed the occurrence. The family members of the complainant also reached the spot and the petitioner fled from there. The complainant was medically examined in Civil Hospital, Zira and later on he was referred to the Civil Hospital, Ferozepur where X-ray examination of the injuries was conducted.

PW-5 Dr. RP Singh, then posted as Medical Officer, Civil Hospital, Ferozerpur conducted the X-ray examination of the injuries on the person of complainant on 22.8.2006 and the result of examination is as under:- "1. One incisor was missing. 2. Two incisors broken Clinical Crown not visible. 3. Fresh blood coming out of socket. 4. Gingival margins torn. 5. Corresponding injury to inner surface of upper lip present. 6. Upper lip Swollen. 7. Diffuse generalized swelling at angle of mandible (right side) visible. Slight tenderness in lower anterior present." The X-ray report is Ex. PW5/A and the X-ray film is Ex. PW-5/B.;
