JUDGEMENT

SANJAY KISHAN KAUL, J. - (1.) LEAVE is granted to respondent No. 41 for placing on record certain documents Annexures R -8 to R -13 and the application is allowed. CWP -23112 -2010
(2.) AN elected government always has the right to lay down an economic policy and philosophy stating the direction in which it would like to move. However, any such policy including to encourage industrialization has to be transparent so that the objective is achieved and everyone gets an equal opportunity. In the present case, we are concerned with what is called "off the shelf scheme for allotment of semi -developed/developed land". Land was sought to be carved out in different sizes for making allotment of plots for industrial purposes as focal points. It appears that the objective was to encourage the process of industrialization as shortage of various kinds of industries was felt in the State having various ramifications including employment generation, revenue generation, ancillary activities to industrial process etc. The policy also states that more than 50 per cent of the plots in the industrial focal points/industrial estate which were developed as far back as five years prior to the policy remained un -sold and discretion was, thus, given to the Punjab Small Industries & Export Corporation to carve out chunks of land by clubbing the un -sold plots alongwith non -saleable area subject to terms and conditions of the scheme. This scheme was propounded on 08/09.04.2008.

ON such clubbing of land and re -carving taking place, the price had to be worked out after adding the current price of saleable plots included in the chunk depending on the land use with the non - saleable area also being priced at the same rate with a discount of 10 per cent being offered on the price worked out in the latter case on account of clubbing of plots.;
