Rakesh Kumar Garg, J. -
(1.) THIS is claimant's appeal challenging the impugned Award on the ground of inadequacy of compensation.
(2.) WHILE passing the impugned Award, the Tribunal observed as under: -
18. Taking into consideration all the facts and circumstances, I am of the considered opinion that the following shall be suitable and adequate amount of compensation for the petitioner under various heads: -
Thus, the total amount assessed in this case comes to Rs. 70,000/ - in lieu of compensation for the injuries sustained by Sudesh Kumar petitioner in the accident. However, since the petitioner also contributed to the accident to the extent of 50 per cent so he is entitled to a sum of Rs. 35000/ - only in this case. I hold accordingly.
According to the learned counsel for the appellant, the compensation has been assessed on the lower side as it has come on record that the claimant received various multiple injuries on different parts of his body.
(3.) IT could not be disputed before this Court that portion of appellant's left ear had been cut and fallen on the road and his three left side ribs were broken and he also received injuries on left side jaw and had been feeling pain and cannot open his jaw completely while taking food and his teeth were also shaken and he remained admitted for 2 -3 days whereas his piece of ear could not be united and then taken to CMC, Ludhiana by his family members where he remained admitted for about two weeks and even after his discharge from the said hospital, the dead portion of his left ear was to be removed and plastic surgery was suggested for which the Medical Officer has estimated the expenses of Rs. 1,50,000/ - to Rs. 2,00,000/ - but he could not get the same done for lack of money.;
