JUDGEMENT

- (1.) As identical questions of law and facts are involved, therefore, I propose to decide indicated petitions bearing CRM No. M-23705 of 2014 titled Rajvinder Singh alias Mithu and others Vs. State of Punjab & others (for brevity "the 1st case) and CRM No. M-23731 of 2014 titled Kamaljit Singh and others Vs. State of Punjab & others, (for short "the 2nd case"), arising out of the same incident/cross-case/FIR, by means of this common judgment, in order to avoid the repetition.
(2.) Tersely, the facts and material, culminating in the commencement, relevant for disposal of the instant petitions and emanating from the record is that, initially in the wake of complaint of complainant Amandeep Singh son of Ranjit Singh-respondent No.2 (for brevity "the complainant in 1st case"), a criminal case was registered against the petitioners-accused Rajvinder Singh alias Mithu and others, vide FIR No.37 dated 03.04.2014 (Annexure P-1), on accusation of having committed the offences punishable under Sections 323, 324, 341, 506 and 148 read with Section 149 IPC (the offence punishable under Section 307 and 326 IPC were later on added), by the police of Police Station Daba, District Ludhiana.

Likewise, in pursuance of separate statement of complainant Rajvinder Singh alias Mithu-respondent No.2 (for short 'the complainant in 2nd case'), a criminal cross-case was also registered against petitionersaccused Kamaljit Singh son of Ranjit Singh and others (in 2nd case), by virtue of DDR No.21 dated 07.04.2014 (Annexure P-1 in 2nd case), for the commission of offences punishable under Sections 323, 341, 324 and 506 read with Section 34 IPC, by means of same FIR by the same very Police Station.;
