By way of this order, I shall dispose of aforesaid petitions as these have emerged out of FIR No. 99 dated 05.06.2011 registered in Police Station Sultanwind, District Amritsar being version and cross version. Vide CRM M 24424 of 2014, the petitioners have prayed for quashing of FIR No. 99 dated 05.06.2011 registered in Police Station Sultanwind, District Amritsar for offence under Sections 323, 324, 326, 148, 149 of the Indian Penal Code, whereas vide CRM M 24426 of 2014, the petitioners have prayed for quashing of cross case for offence under Sections 323, 324, 326, 148, 149 of the Indian Penal Code registered in the aforesaid FIR, on the basis of compromise dated 16.07.2014 arrived at between the parties. Vide this Court's order dated 23.09.2014, the parties were directed to appear before the trial Court to get their respective statements recorded. Simultaneously, the trial Court was also directed to submit its report with regard to genuineness of the compromise arrived at between the parties.
(2.) Now, in compliance thereto, a report from the Judicial Magistrate Ist Class, Amritsar has been received and on reading thereof, it transpires that the parties have entered into compromise voluntarily without any pressure or coercion.
(3.) Counsel for the petitioners contends that the present case is a case of version and cross version and dispute between the parties has been settled by way of compromise. It is further submitted that in version recorded vide aforementioned FIR, both the injured witnesses (respondents No. 2 and 3 in CRM M 24424 of 2014) are yet to be examined during trial and as dispute has been settled, possibility of their supporting cause of the prosecution is remote and bleak.;
