JUDGEMENT

(1.) This order shall dispose of CWP No.15853 of 2014 and COCP No.1842 of 2014 as both are inter-connected. However, the facts are extracted from CWP No.15853 of 2014.

The petitioner has challenged order dated 06.02.2014, denying admission to her in the MBBS course on the ground that all seats under the Wards of Serving Defence Personnel category have been filled up on merit before the turn of the petitioner, without considering her application filed under the S.C. category in which she was at Sr. No.139 and 27 seats were lying vacant in different colleges falling under the aegis of the respondent- University and could be admitted under the said category. She has also prayed for a writ in the nature of mandamus seeking direction to the respondent to admit her to the MBBS course forthwith in the next academic session which is yet to commence, in pursuance of the order dated 20.12.2013, passed by this Court in CWP No.18177 of 2013.
(3.) The brief facts of the case are that the petitioner is a ward of serving defence personnel. She did her matriculation from Army School, Hisar and passed Senior Secondary School Examination from Central Board of Education from Panipat on 28.05.2012. She appeared in the National Eligibility-cum-Entrance Test-UG 2013 (here-in-after referred to as the "NEET-2013") and secured 3624th position in All India Rank (SC Category) and 216th rank in the Punjab State quota seats. She applied for the State quota seats in Haryana, Delhi and Punjab wherein she secured SC category rank as 224, 550 and 216 respectively. Since her State rank was highest in the State of Punjab, therefore, she applied for admission to the University, under the S.C. Category as well as under the Wards of Serving Defence Personnel/Ex-serviceman category. Her name was at Sr. No.139 in the merit list of SC category and at Sr. No.104 in the merit list of the Wards of Serving Defence Personnel category framed by the University for appearance in the 1st counselling held on 04.08.2013. The petitioner appeared for counselling, but her candidature was rejected by the Document Verification Committee, solely on the ground that her father was not posted in the State of Punjab on the date of her admission and she has not passed her 10+2 examination from the State of Punjab which is a pre-requisite for the admission.;
