JUDGEMENT
Mehinder Singh Sullar, J. -
(1.) (Oral) - As, identical questions of law & facts are involved, therefore, I propose to decide the above indicated petitions, arising out of the similar complaints under Section 138 of The Negotiable Instruments Act, 1881 (hereinafter to be referred as "the N.I. Act") between the same parties, by means of this common judgment, to avoid the repetition of facts.
(2.) The epitome of the facts & material, which needs a necessary mention for the limited purpose of deciding the core controversy, involved in the instant petitions and emanating from the record is that, initially, complainant-M/s Innovative Textiles Private Limited Company (for brevity "the complainant-Company") has filed the present complaints (Annexure P-1), in which, M/s JMG Garments, its authorised signatory/Proprietor Manju Garg & her husband and Manager Naresh Garg (petitioner), were summoned to face the trial for the commission of an offence punishable under Section 138 of the N.I. Act, by means of impugned summoning orders dated 25.07.2013 (Annexure P-2), by the trial Court.
(3.) Aggrieved thereby, the revision petitions (Annexure P-3) filed by the accused, were dismissed, by virtue of impugned judgments dated 11.03.2014 (Annexure P-4), by the Revisional Court as well.;
