JUDGEMENT

- (1.) This order shall dispose of the present letters patent appeal which arises from an order passed by the learned Single Judge dismissing execution application No. 3882 of 1989 arising from C.W.P. No. 2253 of 1184 and C.W.P. No. 12375 of 1990 in which the same relief i.e. the order passed by this Court in C.W.P. No. 2253 of 1984 be implemented has been sought and that is why they are being disposed of together by this order.
(2.) Smt. Kirpaljeet Kaur (hereinafter referred to as the appellant) filed C.W.P. No. 2253 of 1984, who was working as Technical Assistant in the office of Director Public Instructions, Punjab in the pay scale of Rs. 200-500 seeking equation and parity with the pay scales of Lecturers (junior scale). This writ petition was allowed by the learned Single Judge on 28.9.1987 and in conclusion, the following directions were issued :- "Consequently, the writ petition is allowed and a writ of mandamus is issued to the respondent State of Punjab to release to the petitioner the same pay scale, that is Rs. 700-1600, which was given to the Lecturers (junior scale), with effect from the date the same was released to those lecturers alongwith the consequential provision for the grant of selection grade. The petitioner shall be entitled to the costs of this petition which are quantified at Rs. 1000/-." Since the respondents did not implement the mandamus issued by this Court, the appellant filed C.O.C.P. No. 44 of 1988 which was disposed of by M.R. Agnihotri, J. on 4.10.1988, with the following directions :- "Consequently, the respondents are once again directed to pay to the petitioner the arrears of the pay and allowances for the entire period with effect from 1st January, 1973, within one month."
(3.) On the basis of the judgment in the writ petition and the aforesaid contempt petition, the petitioner was released the pay scale of Rs. 700-1600 with effect from 1.1.1973 from the date it was released to the Lecturers (junior scale).;
