JUDGEMENT
Naresh Chander Jain, J. -
(1.) The State of Haryana by issuance of two notifications dated 9th July, 1973 under Section 4 of the Land Acquisition Act (hereinafter referred to as 'the Act') which were published in the Haryana Government Gazette on 18th July, 1973, acquired land measuring approximately 175 acres situated in two villages Aurangpur and Sarai Khawaja, Tehsil Ballabgarh, District Gurgaon (now Faridabad). The land was acquired for a public purpose, namely, for development and utilisation of land as residential area in Sector 37. Three separate awards granting different rates were given by the Collector keeping in view the kind of the land, the details of which are unnecessary at this stage, because the District Judge, Faridabad, Shri Surinder Sarup, the Additional District Judge, Shri Hari Ram, and the Additional District Judge, Shri Suresh Chand Jain (I), Faridabad, have vide their awards under challenge before this Court have evaluated the land at much higher rates. Shri Hari Ram, Additional District Judge, Faridabad, in his Award, dated 25th April, 1979, determined the market value of the acquired land at Rs. 310/- per marla giving rise to filing of R.F.A. Nos. 1724, 1725, 1565 and 1567 of 1979. Shri Suresh Chand Jain, Additional District Judge, Faridabad, vide his award, dated 24th February, 1984, assessed the market value of the acquired land at the market value of the acquired land at the rate of Rs. 18/- per square yard out of which R.F.A. No. 1243 of 1984 has arisen. Shri Surinder Sarup, District Judge, Faridabad, has also determined the market value of the acquired land at the rate of Rs. 18/- per square yard, giving rise to R.F.A. No. 1143 of 1983 and Cross-Objections No. 112-CI of 1986 in R.F.A. No. 1143 of 1983.
(2.) M/s. Raj Dhani Land and Finance (P) Limited have preferred RFA Nos. 1724 and 1725 of 1979. RFA Nos. 1566, 1667 of 79 and 1143 have been preferred by the State of Haryana R.F.A. No. 1243 of 1948 has been filed by Des Raj landowners and Cross-objections No. 112-CI of 1986 in R.F.A. No. 1143 of 1983 has been preferred by Pal Singh, respondent-claimant. Since all the appeals have arisen out of the notifications of one and the same date, they are being disposed of together by way of this judgment. The counsel for the parties were agreed during the course of arguments that this Court may pick up the facts from R.F.A. No. 1724 of 1979 filed by M/s. Raj Dhani and others v. State of Haryana.
(3.) At the very outset, it is necessary to give a brief background of certain orders passed when these appeals remained pending for decision in this Court during these 14 years.;
