JUDGEMENT
Ajit Singh Bains, J. -
(1.) Smt. Ranjit Kaur petitioner, wife of Vijay Pal Singh respondent, filed, an application under section 125 of the Code of Criminal Procedure stating therein that she was the wife Vijay Pal Singh respondent and the marriage was solemnised on 18th Feb., 1976 and the parties lived as husband and wife upto Oct., 1977, when she was forcibly turned out of the house by the respondent. It was further alleged that no child was born out of the said wedlock, that after the marriage the respondent (husband) demanded money occasionally, and she brought Rs. 2,000 and Rs. 3,000. However, the husband again demanded Rs. 10,000 in Oct., 1977, to which she showed her inability and as a result, thereof, she was turned out of the house and since then she had been residing with her parents. It was also alleged that she had no source of income and her parents were unable to maintain her and that her husband had sufficient means to earn and he was earning Rs. 3,000 per month and she claimed Rs. 500 per month as maintenance.
(2.) The learned Chief Judicial Magistrate, Kurukshetra allowed her application and granted her maintenance of Rs. 150 per month from the date of her application. i.e. 1st Aug., 1980. Dissatisfied by the order of the Chief Judicial Magistrate, the husband filed revision petition, which was allowed by the learned Additional Sessions Judge, Kurukshetra and the order of the Chief Judicial Magistrate was set aside. Hence this revision petition by the wife.
(3.) The petitioner has also placed on record copy of the judgment dated 17th Nov., 1982, passed by the learned Additional District Judge (I), Kurukshetra, whereby the petition under section 13 of the Hindu Marriage Act filed by the wife was allowed and the marriage between the parties was dissolved. In those proceedings, the dissolution of marriage by a decree of divorce was sought by the wife petitioner) on the grounds of cruelty and pesertion. The respondent in the written statement denied the allegation of cruelty but admmitted the allegation of deseration.;
