JUDGEMENT

S.S. Dewan, J. - (1.) Ram Sarup, petitioner, was convicted under Sec. I6(I)(a)(i) read with Sec. 7(1) of the Prevention of Food Adulteration Act (for short 'the Act') and sentenced to six months rigorous imprisonment and a fine of Rs. 1000.00 by the Chief Judicial Magistrate, Chandigarh. On appeal, the learned Additional Sessions Judge, Chandigarh, upheld the conviction and sentence of the petitioner. This revision petition is directed against the aforesaid judgments.
(2.) The prosecution case is in a very narrow compass. On July II, 1978, Prem Singh Government Food Inspector, intercepted the accused petitioner in village Burrail and found him having in his possession about 20 Kgs. of un-indicated milk contained in a drum. The Food Inspector purchased 660 Mis. of milk from the petitioner for analysis for Rs. 1.60 Ps. After observing the formalities the sample was sent to the Public Analyst and the same was found to be deficient in milk fat by 47 per cent and milk solids not fat by 2 per cent.
(3.) The case against the petitioner rests primarily on the unimpeachable testimony of Prem Singh Food Inspector and Sardui Singh, an Assistant in the office of the Local (Health) Authority. The petitioner denied the prosecution allegations and pleaded false complicity in the case, but adduced no evidence in defence.;
