JUDGEMENT

- (1.) Amarjit Singh has filed this writ petition under Articles 226/227 of the Constitution of India for issuance of a direction to the respondents, restraining them from recovering any money from the petitioner and staying his arrest.
(2.) Briefly stated the facts of the case are that Amarjit Singh, petitioner is a resident of village Mardanpur, Tehsil Rajpura, District Patiala. There is a Co-operative Agricultural Service Society Limited in the petitioner's village but he is not a member of the same. The petitioner has never obtained any loan from the society and has no dealings with it. The petitioner was not summoned by any functionary or authority of Co-operative Department. No proceedings or enquiry was held against him in his presence. The petitioner came to know that warrant of arrest had been issued against him for the recovery of a sum of Rs. 2361/- purporting to be due from him to the village Co-operative Society mentioned above. Despite best efforts of the petitioner, no copy of the award fixing any liability of the petitioner was given to him. He has contended that if there is any award in existence against him that has been made without associating the petitioner and is bad in law.
(3.) At the stage of motion hearing Mr. I.S. Sidhu, Advocate had appeared on behalf of the respondent-Society. However. no return was filed on behalf of the Society at that stage or even later on. In this situation, the factual averment made in the petition have to be accepted to be true.;
