JUDGEMENT

(1.) The present petition has been filed under Section 482 Cr.P.C. for quashing the FIR No.140 dated 11.05.2011(Annexure P-1) for the offence under Sections 498-A, 406 IPC registered at Police Station Surajkund District Faridabad on the basis of compromise dated 05.10.2011(Annexure P-2 ).

The marriage of the petitioner was solemnized with respondent No.2-complainant on 17.02.2010 at Faridabad but due to some temperamental differences arose between them, which resulted into filing of litigations by both the parties. Now parties with the intervention of respectable and relatives, have compromised the matter by filing petition under Section 13-B of the Hindu Marriage Act by way of mutual consent. As they have mutually decided to part ways it has been agreed that both the parties will withdraw their respective litigations against each other and will cooperate in quashing/cancellation of FIR's. It has also been agreed to pay an amount of Rs.40 lacs as permanent alimony, maintenance and property rights. All claims towards dowry articles, istridhan, personal belonging have been settled. It has been agreed that an amount of Rs.20 lacs has been paid at the time of recording of first motion. It has been agreed that Rs.20 lacs will be paid at the time of recording of second motion.

Counsel for respondent No.2 states that Rs.20 lacs have been paid to her on 05.10.2011 vide pay order No.141483 dated 04.10.2011 and pay order No.141484 dated 05.10.2011 and the second installment of Rs.20 lacs will be paid in the month of April, 2012. As per the condition of the compromise, now she is having no objection if the FIR in question with consequential proceedings arising therefrom, is quashed qua petitioners. The compromise is voluntarily and without any pressure. As per compromise (Annexure P-2), both the parties have settled the dispute amicably as per the conditions recorded in the compromise. Counsel for the respondent No.2 does not dispute the genuineness of the compromise (Annexure P-2 ) annexed with the petition.;
