JUDGEMENT

(1.) ter having qualified as B.Tech. in the year 1997, the petitioner did his M.Tech. in the year 2002. Thereafter, the petitioner published research papers from NIT Kurukshetra. Later, the petitioner applied for Ph.D. registration in terms of the prospectus issued in the year 2004 (Annexure P-1). The petitioner though had applied for full time course but in the meanwhile he joined as a Lecturer in Maharishi Markendeshwar Engineering College, Mullana, District Ambala. He submitted no objection certificate as well.
(2.) A pre-registration seminar was conducted under the supervision of Dr.Baldev Setia, Assistant Professor from Department of Civil Engineering NIT Kurukshetra. The petitioner was registered as Ph.D. candidate on 1.4.2006. The registration order otherwise mentioned the petitioner as full time. The petitioner claims to have approached the concerned authority for correction of the same and was directed to deposit the fee as applicable to the part time Ph.D., which he accordingly did. The petitioner appeared for comprehensive examination on 1.5.2007. He also submitted his progress reports from time to time while presenting himself as Lecturer for his part time course.
(3.) On 25.4.2008, the Deputy Registrar had written a letter to the petitioner, directing him to deposit the semester fee at his working address of Mullana Engineering College. The petitioner accordingly states that there was no concealment on his part regarding his appointment as Lecturer to the respondent-Institute.;
