JUDGEMENT

(1.) Maru Singh Mahila Ayurvedic Degree College, Sonipat, was set up in the year 1975. In the year 2011-12, the petitioner- college was declared deficient in terms of faculty position. The College had then filed Civil Writ Petition No.18103 of 2011 and this Court allowed admission in B.A.M.S. Course for session 2011-12.

Inspection has again been carried out by the Central Council of Indian Medicine (CCIM) on the basis of norms prescribed vide instructions dated 18.3.2011, followed by criteria laid down vide communication dated 21.3.2011. For 50 seats in B.A.M.S. Course, the College is required to have 32 teachers as per the norms. As per the petitioner-College, it is having 34 teachers on the roll as professors, associate professors and Assistant Professors. The respondents, after inspection, however have declared three teachers ineligible out of 34 on the roll of the college vide its order dated 17.8.2012 (Annexure P-2). The College accordingly has been declared deficient by one teacher.
(3.) It is urged that one of the teacher has a teaching experience of 16 years in the College but still has been declared ineligible. Another teacher, who is working as a Reader/Associate Professor, has requisite experience but is declared ineligible on the ground that there is a gap of number of years in between the period of his employment with the previous College and his appointment with the present College. As per the petitioner, during these years said teacher had worked as Research Scientist in the relevant field of specialty. The petitioner accordingly would term this action of the respondents to hold these teachers ineligible to be arbitrary and violative of Article 14 of the Constitution of India.;
