JUDGEMENT

MEHINDER SINGH SULLAR,J. - (1.) PETITIONER Devender Singh son of Rajinder Singh has preferred the instant petition for the grant of anticipatory bail in a case, registered against him along with his other co-accused, by way of FIR No.149 dated 17.11.2012 (Annexure P1), on accusation of having committed the offences punishable under sections 363 and 366 IPC (the offences u/ss 420, 467, 468 and 471 IPC were subsequently added) by the Police of Police Station Sadar Roop Nagar, invoking the provisions of section 438 Cr.PC.
(2.) NOTICE of the petition was issued to the State. After hearing the learned counsel for the parties, going through the record with their valuable help and after considering the entire matter deeply, to my mind, the present petition deserves to be accepted in this context.
(3.) DURING the course of preliminary hearing, the following order was passed by this court on 14.12.2012:- "Learned counsel, inter-alia, contended that Ranjit Kaur daughter of the complainant has fallen in love and voluntarily performed her marriage with the petitioner on 17.12.2012, vide marriage certificate (Annexure P2). Apprehending danger to their lives they filed the joint protection petition, which was granted by this Court, vide order dated 19.11.2012, in Crl. Misc.No.M -36433 of 2012 (Annexure P4). Ranjit Kaur, who is today present in the Court, has acknowledged the factum of her marriage with the petitioner. The argument is that under these circumstances no indicated offences are made out against the petitioner and he has been falsely implicated in the instant case by the complainant. Moreover, Jaswinder Singh @ Jassi and Harjang Singh @ Janga (co-accused of the petitioner) have already been allowed bail by this Court in Crl.Misc.No.M-38022 of 2012. Heard. Issue notice of motion to the respondent, At this stage, Mr.Sanjay Nagpal, Advocate appears and accepts notice on behalf of the complainant and seeks time to argue the matter. Adjourned to 21.12.2012 for arguments, at the request of counsel for the complainant. Meanwhile, the petitioner is directed to join the investigation before the next date of hearing. In the event of his arrest, the Arresting Officer would admit him to bail on his furnishing adequate bail and surety bonds in the sum of Rs.25,000.00 to his satisfaction." ;
