JUDGEMENT

- (1.) The present petition has been filed under Section 482 Cr.P.C. for quashing of FIR No. 162 dated 08.12.2010 under Section 406/498-A of the Indian Penal Code (for short 'the Code'), registered at Police Station Kotwali, Nabha, District Patiala (Annexure P-1), on the basis of compromise dated 08.11.2011 (Annexure P-2).
(2.) Brief facts of the case are that the marriage petitioner No. 3 and respondent No. 2 was solemnized on 10.12.2009 at Samana, District Patiala, according to Hindu Rites. No child was born out of this wedlock. Thereafter, the relationship between them became strained. Respondent No. 2/complainant levelled allegations of harassment and demand of dowry by the petitioners. In the above background, F.I.R was registered against the petitioners.
(3.) With the intervention of respectable of the respectables and relatives of the parties, the disputes between them have been resolved amicably. They want to live in peace and harmony and do not want to pursue any legal proceedings against each other. It has been further decided that petitioner No. 3 would pay a sum of Rs. 11,50,000/- to respondent No. 2. Out of the said amount, Rs. 5,50,000/- has already been paid by petitioner No. 3 to respondent No. 2. It was further decided that Rs. 2 lacs will be paid by petitioner No. 3 at the time of quashing of F.I.R and remaining 4 lacs would be paid at the time of grant of decree of divorce. Respondent No. 2 will not claim any maintenance i.e past, present or future from petitioner No. 3. Respondent No. 2 does not want to proceed against the petitioners and the compromise has been entered without any fear, duress and pressure from any quarter. It has further been decided that no party would initiate any civil or criminal proceedings against each other and respondent No. 2 would fully cooperate in truncating the proceedings in the present F.I.R. Compromise deed is dated 08.11.2011 (Annexure P-2).;
