JUDGEMENT

(1.) The instant petition has been filed with a prayer that
investigation in case registered vide FIR No.439 dated 7.6.2011
under Sections 302/201/323/34 IPC at Police Station Civil Lines,
Karnal be handed over to Central Bureau of Investigation or to
some any other independent investigating agency.
(2.) The FIR discloses the unnatural and violent death of
Karam Singh, father of the petitioner, who was an ex-sarpanch of
the village. As per the averments made in the petition, it has been
stated that Sandeep son of Chamel Singh, who is nephew of said
Karam Singh had applied for the post of Clerk to the Haryana
Staff Selection Commission and his interview was scheduled for
24.7.2010. Both of them met Sanjay, stated to be a relative of Sh.
Om Parkash Jain, holding a ministerial assignment, and requested
for his help. Sanjay directed Karam Singh to meet the Minister at
Panipat where Atul Jain met them and asked them to come on the
following day with necessary papers. It is alleged that a sum of
Rs.5 lacs was demanded by Sh. Om Parkash Jain and the amount
was directed to be paid to one Rajender Sharma at his house in
Panipat. Karam Singh is said to have paid a sum of Rs.4.5 lacs to
Rajender Sharma at Panipat and in lieu thereof a job was assured
to Sandeep.
(3.) The petitioner himself had applied for the post of
Conductor and a sum of Rs.6.5 lacs was demanded from him
which was later on scaled down to Rs.6 lacs. In a similar fashion
a sum of Rs. 3 lacs was paid for procuring the job of Conductor
to the petitioner, but none of these two transactions materialised
favourably and thus the father of the petitioner demanded a sum
of Rs.7.5 lacs to be returned to him. Incidentally, another relative
of the petitioner, namely Sunil had also applied for his
recruitment in Haryana Police and also cleared the physical
efficiency test and had to appear for interview before the
recruitment board. One Sh. Jile Ram Sharma, respondent No.5,
who was holding the post of Chief Parliamentary Secretary in the
Government of Haryana, demanded a sum of Rs. 5 lacs for
helping Sunil in the recruitment and he said that a sum of Rs.4,
95,000/- was paid to said Sh.Jile Ram Sharma but even Sunil
could not get the employment. The amount was demanded back
but instead of the entire amount being refunded Sh. Jile Ram
Sharma said a sum of Rs.4 lacs only would be returned. Karam
Singh, however, insisted on the return of entire amount.;
