JUDGEMENT

- (1.) On December 24, 2009, this Court passed the following order: Learned Counsel for the Petitioner inter alia contends that the 12 cows and 11 calves, which were taken in possession were handed over to the Petitioner on sapurdari. However, the same have been released by the learned Sub Divisional Judicial Magistrate, Rajpura to one Munna Lal Sharma (Respondent No. 5) who is stated to be attorney of Respondent Nos. 2 to 4. It is submitted that the cows in all probability would be slaughtered in case they are given to Munna Lal Sharma (Respondent No. 5). It is further submitted that the cows are still in the custody of the Petitioner. Notice of motion for 9.2.2010. In the meantime, operation of the order dated 26.11.2009 passed by the learned Sub Divisional Judicial Magistrate, Rajpura shall remain stayed.
(2.) Learned Counsel for the Petitioner is not in a position to state the status of the trial. However, to sort out the controversy, it is directed that the trial Court shall conclude the trial arising out of case FIR No. 259 dated 17.10.2009 under Section 11 of Prevention of Cruelty to Animals Act, 1960 registered at Police Station Rajpura within a period of 6 months from the date of receipt of a certified copy of this order. Till conclusion of the trial, interim order dated 24.12.2009 passed by this Court shall remain in vogue.
(3.) Needless to say, at the time of conclusion of the trial, trial Court in its judgment shall specify as to who is entitled to the custody of cows and calves. Disposed of.;
