JUDGEMENT

(1.) The petitioner has filed the present Public Interest Litigation under Article 226 of the Constitution against the order dated 11.5.2011 (P-9), passed by the Deputy General Manager of the Power Grid Corporation of India Ltd.-respondent No. 3 deciding the representation of the petitioner, dated 1.2.2011 (P-6) with regard to installation of transmission line towers in agricultural land at village Sakatpur, Gurgaon. The petitioner has also challenged the decision taken by the Power Grid Corporation of India Ltd.- respondent Nos. 2 to 4 (for brevity, 'the respondent Corporation') in taking U-turn in constructing the transmitting towers, by alleging that it would cover more land/area and cause burden on the State exchequer. Still further it has been prayed that respondent Nos. 1 to 4 be directed not to implement the subsequently approved plan.

Brief facts of the case are that with a view to provide transmitting towers from the existing lines to Manesar Power House, the respondent Corporation prepared a plan and decided to erect transmitting towers for supply of power from village Saketpur to Manesar. The grievance of the petitioner is that initially the respondent Corporation approved a plan for providing transmitting line to the area by way of constructing transmitting towers in a straight line from Point 'A' to Point 'C' as shown in the rough site plan (P-2). However, in order to favour the influential persons, the plan has been changed and instead of the straight line, it has been decided to construct the transmitting towers by taking a U-turn. It is alleged that in case the transmitting towers are allowed to construct in U-Turn shape it would cover more agricultural area and also increase the burden on State exchequer because the cost of erecting transmitting towers and laying of transmitting line would increase tremendously.

It is pertinent to mention here that earlier the petitioner filed CWP No. 6881 of 2011, which was disposed of by this Court vide order dated 21.4.2011 (P-8) by observing that the question about deciding the ideal route for a transmission line is primarily a technical question that should be decided by the experts. However, considering the fact that the petitioner had filed a representation to the respondents, which was yet to be answered, a direction was issued to the respondents for early disposal of the petitioner's representation dated 1.2.2011. Liberty was also granted to the petitioner to raise any further grievance in respect of the order to be passed by the respondents.;
