JUDGEMENT

(1.) The petitioners have approached this Court in terms of filing the present writ petition under Article 226 of the Constitution of India praying for the issuance of a writ in the nature of Mandamus for directing the respondent/authorities to appoint them on the post of Assistant Cashiers in the Treasury & Accounts Department, State of Punjab.

The facts that would require notice are that the respondent/department had issued an advertisement bearing No.5 of 2011 on 23.09.2011 inviting applications for various posts including the post of Assistant Cashier. A copy of relevant extract of the advertisement has been appended as Annexure P-1 along with the petition. It has been asserted that the petitioners were eligible and had applied for the post of Assistant Cashiers. Petitioner No.1 applied against the reserved category of Ex-servicemen and petitioner No.2 had applied under General Category. Both the petitioners were allotted registration numbers and had participated in the written test. In the result that was declared, petitioner No.1 is stated to have secured 41.25 marks and stood at 4 th position in his reserved category and petitioner No.2 secured 56.25 marks and stood at 2 nd position in the general category. It has further been averred that the petitioners were even called for the counselling process.

Learned counsel for the petitioners contends that in spite of having secured high marks and having been assigned position in the merit, they have not been given appointment to the post of Assistant Cashiers. Even though, no communication has been conveyed to them, learned counsel contends that the appointment has been denied to them on the ground that they do not possess the requisite experience certificate.;
