JUDGEMENT

- (1.) This PIL has been filed seeking directions for initiation of legal action against the persons named in the complaint (Annexure P-7) filed by the petitioners. The aforesaid complaint of the petitioners is in respect of alleged embezzlement of money belonging to them which though entered in their passbooks (Post Office Savings) had not been reflected in the accounts of the Post Office duly supported by Vouchers. Consequently, though the petitioners claim to have deposited several instalments, credits for all such instalments have not been given to them and they are not allowed to withdraw all of the amounts deposited. It is our considered view that instead of agitating the aforesaid grievance before this Court, the petitioners should approach the competent authority who on due and proper verification and inquiry may lodge a formal complaint in this regard with the police, if so required.
(2.) Learned counsel for the petitioners has sought to answer the aforesaid query of the Court by drawing the attention of the Court to the complaint (Annexure P-7) which was filed before the PGM, Punjab Circle on 9.1.2012. Evidently the said complaint has not been attended to till date.
(3.) Taking into account what has been stated above and the fact that the complaint of the petitioners is yet to be addressed, we are of the view that, at this stage, the PGM, Punjab Circle should be directed to look into the matter and on due inquiry, if the allegations are found to be correct, to take necessary action in accordance with law including filing of a complaint before the jurisdictional police station. The PGM, Punjab Circle will take necessary action in the matter as directed within a period of four weeks from the date of receipt of this order or a certified copy thereof.;
