VERSUS
STATE OF PUNJAB Respondents

JUDGEMENT

MEHINDER SINGH SULLAR,J. - (1.) THE epitome of the facts & material, culminating in the commencement, relevant for deciding the instant petition and emanating from the record, is that, initially, in the wake of complaint of complainant Amandeep Kaur, daughter of Resham Singh respondent No.2 (for brevity "the complainant"), a criminal case was registered against petitioners- accused Balwinder Singh son of Swaran Singh and his son Kawalnain Singh, by way of FIR No.60 dated 15.5.2011 (Annexure P-1), for the commission of offences punishable under Sections 420 and 120-B IPC by the police of Police Station Cantonment City, Amritsar.
(2.) DURING the course of investigation of the criminal case, good sense prevailed and the parties have amicably settled their disputes, by virtue of compromise/affidavit dated 4.9.2012 (Annexure P-2) of the complainant. Having compromised the matter, now the petitioners-accused have preferred the present petition, to quash the impugned FIR (Annexure P-1) and all other subsequent proceedings arising therefrom, invoking the provisions of Section 482 Cr.PC, inter-alia, pleading that the complainant has compromised the matter with the accused. There is no grudge whatsoever remains between the parties. They want to live in peace in future. The complainant has no objection if the criminal case registered against the petitioners, by means of impugned FIR (Annexure P-1) is quashed. On the strength of aforesaid grounds, the petitioners- accused sought to quash the impugned FIR (Annexure P-1) and all other consequent proceedings arising thereto in the manner depicted here- in-above.
(3.) DURING the course of preliminary hearing, the Magistrate having the jurisdiction was directed to record the statements of all the concerned parties, with regard to the genuineness and validity or otherwise of the compromise (Annexure P-2) between them, by this court, by way of order dated 11.10.2012.;
