JUDGEMENT

RAM CHAND GUPTA - (1.) THE present petition has been filed for anticipatory bail under Section 438 of Code of Criminal Procedure in FIR no.26 dated 07.03.2012, under Sections 376/366/506/120B IPC, registered at police station Rangar Nangal, Tehsil Batala, District Gurdaspur.
(2.) I have heard learned counsel for the parties and have gone through the whole record including the impugned order passed by learned Additional Sessions Judge, Gurdaspur dismissing anticipatory bail application filed on behalf of the petitioners. This Court while issuing notice of motion on 08.05.2012 passed the following order:- "Crl.M.No.27296 of 2012 Application is allowed subject to all just exceptions. Crl.M.No.M-13353 of 2012 Contends that on the date of alleged occurrence, prosecutrix was major as per certificate, Anenxure P1, issued by Punjab School Education Board as her date of birth is 2.1.1993. It is further contended that hence, prosecutrix had gone with co-accused Gurjant Singh with her free will and thereafter they performed marriage in a Gurudwara even as per version of the FIR. Further submitted that even photographs, on which prosecution has placed reliance, shows that no other person except the couple was present at the time of performance of marriage. Further contends that the present petitioners have been falsely implicated in this case being related to Gurjant Singh. Notice of motion for 21.5.2012. In the meantime, petitioners, three of whom are ladies, are directed to join the investigation and in case they are arrested, they shall be released on interim bail by the Arresting Officer to his satisfaction subject to compliance of conditions specified under Section 438(2) Cr.P.C."
(3.) IT has been contended by learned counsel for the petitioners that they have already joined the investigation pursuant to said order dated 08.05.2012.;
