JUDGEMENT

- (1.) SUMAN T., the petitioner seeks pre-arrest bail in a case registered by way of FIR No. 158 dated 21.04.2010 at Police Station Sadar Amritsar, District Amritsar, for an offence punishable under section 304-B read with section 34 IPC.
(2.) LEARNED counsel for the petitioner submits that the petitioner is the married sister-in-law of the deceased, who is staying at Jalandhar and the occurrence took place at Amritsar. According to him, after due investigation, the petitioner was found innocent and her name was placed in column no.2 of the challan. He further submits that at the trial, application was made under the provisions of section 319 of the Code of Criminal Procedure and the trial court has summoned the petitioner to stand trial as an accused alongwith the persons, who had been sent to stand trial. He has drawn my attention to Annexure P-2, a copy of passport of the petitioner, which shows that the petitioner is residing at Jalandhar. He further submits that in pursuance of the directions of this court dated 03.05.2012 , the petitioner has appeared before learned trial court and has been admitted to interim bail. Learned State counsel, on the other hand, is unable to dispute the submissions made by learned counsel for the petitioner. The fact of the case is that the police found the petitioner to be innocent. The petitioner is the married sister-in-law of the deceased, who was living separately and now she has been summoned under the provisions of section 319 of the Code of Criminal Procedure. The petitioner appeared before learned trial court in pursuance of the directions of this court vide order dated 03.05.2012 and has been admitted to interim bail.
(3.) IN this view of the matter, without commenting on the merits of the case, the petition is allowed and order dated 03.05.2012 granting interim bail to the petitioner is made absolute.;
