JUDGEMENT

The epitome of the facts & material, culminating in the commencement, relevant for the limited purpose of deciding the core controversy, involved in the instant petition and emanating from the record, is that, initially, in the wake of complaint of complainant Avtar Singh SDO, Punjab State Power Corporation Limited, respondent No.3 (for brevity "the complainant"), a criminal case was registered against petitioners-accused Jasvir Singh & Resham Singh, for having abused and slapped Sukhjit Singh JE (respondent No.2), by means of FIR No.7 dated 21.2.2012 (Annexure P1), for the commission of the offences punishable under sections 353 and 186 IPC by the police of Police Station Baja Khana, District Faridkot.
(2.) During the course of investigation of the criminal case, good sense prevailed and the parties have amicably settled their disputes, by virtue of compromise dated 7.4.2012 (Annexure P-2).

Having compromised the matter, now the petitioners-accused have preferred the present petition, to quash the impugned FIR (Annexure P-1) and all other subsequent proceedings arising therefrom, on the basis of compromise (Annexure P2), invoking the provisions of Section 482 Cr.PC, inter-alia, pleading that both the parties have amicably settled their dispute and removed mis-understanding. They have decided not to take any further action against each other. Neither the complainant nor the victim have any objection if the criminal case registered against the petitioners-accused, by way of impugned FIR (Annexure P-1) is quashed. It was claimed that the compromise will enhance the social amity and reduce the friction between the employees of the Power Corporation and the villagers as they have to work for each other daily. It will be in the interest of both the parties and their families. They want to live happily and peacefully in future. On the strength of aforesaid grounds, the petitioners-accused sought to quash the impugned FIR & all other consequent proceedings arising thereto, in the manner depicted here-in-above.;
