- (1.) Quashing of FIR No. 5 dated 14.1.2011 under Sections 307, 323, 452, 148, 149 IPC registered at Police Station Shimplapuri, District Ludhiana (Annexure P1) is sought on the basis of compromise (Annexure P2).
(2.) As per the FIR the complainants were running Sahil Hospital and Nursing Home at House No. 11726, Gali No.3, Sahibzada Ajit Singh Nagar. One Avdesh Kumar was working in the Hospital and on the day of Lohri festival he informed that 5-6 boys had come and attacked the hospital staff. One of the boys named Chini received an injury on the head and required stitches for the same. Avdesh Kumar was also given some beating in the process. When Avdesh Kumar refused to bandage him some other boys by the name of Sourabh, Vicky and Vikas came and break the glasses of the main gate, windows and doctor's chamber. On reaching the spot the complainant came to know about the incident. In this background the present FIR was registered.
(3.) During the pendency of the investigation a compromise was effected between the parties on 1.3.2011. All the accused admitted their guilt assuring that in future they will not harm the Doctor or his staff. They apologized on 15.1.2011 in writing. All the accused and their guardian assured doctor Rajinder Kumar Sood in front of respectables of the locality that such incident would not occur again.;
