JUDGEMENT

(1.) The petitioner has filed this writ petition for issuing writ or direction commanding the respondents to treat the petitioner as a regular student of Second Professional Examination of Bachelor of Medicine and Surgery (MBBS Course) as he has cleared all the subjects of the First Professional Examination in the requisite time as stipulated by the University. Prayer further is to direct the respondents to allow the petitioner to attend the classes and to take the examinations of Phase II of MBBS Course as interim measure, subject to the decision of this writ petition.
(2.) The petitioner was admitted to MBBS Course under NRI quota in May/June, 2010 in Guru Gobind Singh Medical College, Faridkot. The petitioner appeared in the First Professional Examination of the MBBS in May/June, 2011. The petitioner passed all other subjects, except in the subject of Anatomy. The petitioner got 're-appear' in the subject of Anatomy. As per the rules/regulations, the petitioner could clear this paper of Anatomy till December, 2012. As per the Ordinance of the University, MBBS student can take maximum of 6 chances to clear the subject, in which he/she is not able to obtain the requisite score. If the student is not able to clear the subject in 6 attempts, he/she will have to repeat all the subjects of that examination.
(3.) The petitioner appeared in the Supplementary examination held in September, 2011, but could not clear the paper of Anatomy. Thereafter, the petitioner again appeared in examination in May/June, 2012 and has cleared the said paper as well.;
