JUDGEMENT

- (1.) The present revision petition brought by Smt. Gurjit Kaur alias Jeeto against the respondents, State of Punjab and others is directed against the order dated 30.10.2010 passed by learned Sessions Judge, Ferozepur. Vide the impugned order, learned Sessions Judge, Ferozepur discharged Surjit Singh, Kashmir Singh and Bagicha Singh, who had been sent to stand trial by Police Station Makhu for an offence punishable under section 148, 302 read with section 149 IPC in a case registered by way of FIR No. 142 dated 18.9.2008. Before proceeding further, it is necessary to briefly notice the facts set up by the State against the above named three persons.
(2.) On 27.4.2008, Chaggar Singh, Sub Inspector received telephonic information that a person had committed suicide in village Manjhwala. He went to the spot. He had found Swaran Singh there and recorded his statement. Swaran Singh told that they had been four brothers and Santokh Singh (deceased) had been one of them. He further claimed that they had a land dispute with Santa Singh, Surjit Singh, Bagicha Singh, Resham Singh, Kashmir Singh and Sukhdev Singh. According to him, at about 4.00/4.30 AM on that day itself, Santokh Singh went to the fields to answer the call of nature but did not return till 8.00 AM and then all the family members started searching him.
(3.) He further told Chaggar Singh, SI that at about 9.00 AM, they came to know that dead body of Santokh Singh was hanging to a Mulberry tree at the back of the baithak of Kashmir Singh son of Santa Singh. They went there and found the dead body of Santokh Singh. Suspecting Santa Singh, his sons and his grandson Sukhdev Singh to have killed Santokh Singh and to have hanged his dead body on the Mulberry tree, the report was lodged.;
